Terms of Service

By accessing or using the Hextiria platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

1. Use of the Service

Hextiria provides an AI Business Operating System for business management purposes. You agree to:

• Use the Service only for lawful business purposes
• Not share your login credentials with unauthorised individuals
• Maintain accurate and up-to-date information in your account
• Comply with all applicable laws and regulations, including Saudi Labour Law, GOSI regulations, and ZATCA requirements

2. Account Responsibilities

You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account. We are not liable for losses caused by unauthorised use of your account if you fail to notify us promptly.

3. Data Ownership

You retain full ownership of all data you input into the Hextiria platform. We process your data solely to provide the Service. We do not claim any ownership rights over your business data, employee records, or financial information.

4. Service Availability

We strive for 99.9% platform uptime. We may temporarily suspend the Service for scheduled maintenance with advance notice. We are not liable for downtime caused by factors outside our reasonable control (force majeure events, infrastructure failures, etc.).

5. Subscription and Payment

Subscription fees are billed as agreed at the time of purchase. All prices are in Saudi Riyals (SAR) unless otherwise stated. Annual subscriptions are non-refundable after the first 14 days. Monthly subscriptions may be cancelled at any time, effective at the end of the current billing period.

6. Prohibited Uses

You may not use the Service to:

• Store or process data in violation of applicable laws
• Attempt to gain unauthorised access to other accounts or systems
• Introduce malicious code or interfere with the Service's operation
• Resell or sublicense the Service without our written consent
• Use the Service to process data for individuals or organisations under international sanctions

7. Intellectual Property

All intellectual property rights in the Hextiria platform, including its design, code, algorithms, and AI models, remain the exclusive property of Hextiria and its licensors. These Terms do not grant you any ownership rights in the platform.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Hextiria shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the fees you paid in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Saudi Arabia.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a notice in the platform. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
